Article 1 – Definitions
Within these General Terms and Conditions, the following definitions apply:
Withdrawal Period
The period during which a consumer is entitled to cancel the agreement without providing a reason.
Consumer
Any natural person who enters into an agreement for purposes that are not related to their commercial, business, or professional activities.
Calendar Day
Any day counted as a full calendar day.
Subscription Agreement
A distance contract concerning products or services that are delivered or purchased periodically over a specified timeframe.
Durable Medium
Any method that enables information addressed to a consumer or entrepreneur to be stored in a way that allows future consultation and reproduction without alteration.
Right of Withdrawal
The consumer’s legal entitlement to terminate a distance agreement within the applicable withdrawal period.
Entrepreneur
The natural or legal person offering goods or services to consumers through remote selling channels.
Distance Contract
An agreement concluded through an organized system for remote sales, where communication takes place exclusively via distance communication methods up to the moment the contract is finalized.
Remote Communication Method
Any means used to establish a contract without the parties being physically present in the same location.

These contractual provisions governing the relationship between the entrepreneur and the consumer.

Article 3 – Scope of Application
These General Terms and Conditions apply to every offer made by the entrepreneur and to all agreements concluded between the entrepreneur and consumers through distance selling.
Before completing a purchase, the consumer will be given the opportunity to review these terms. If this is not reasonably possible, the entrepreneur will inform the consumer how the terms can be accessed electronically and will provide them free of charge upon request.
If additional conditions apply to particular products or services, those conditions will apply alongside these terms. In the event of conflicting provisions, the clause most beneficial to the consumer will prevail.
Should any provision of these terms be declared invalid or unenforceable, the remaining provisions will remain in full force. The invalid clause will be replaced with a provision that most closely reflects the original intention.
Article 4 – Offers
Offers presented by Amalia Claire Boutique may be subject to specific limitations, conditions, or time restrictions. When this is the case, it will be clearly indicated.
All offers are non-binding. The entrepreneur reserves the right to modify, suspend, or withdraw any offer at any time.
Product descriptions aim to provide an accurate representation of the items offered. Images are intended for illustrative purposes; small variations in color, appearance, or design may occur.
Each offer will clearly state:

Article 5 – Conclusion of the Agreement
A purchase agreement becomes effective once the consumer accepts the offer and fulfills the necessary conditions specified by the entrepreneur.
When the agreement is confirmed electronically, the entrepreneur will promptly acknowledge receipt of the order through electronic confirmation.
Until confirmation of acceptance has been provided electronically, the consumer may cancel the agreement.
Article 6 – Right of Withdrawal
Consumers have the right to return non-discounted products within 30 days after receiving the order, without providing a reason.
To qualify for a return, items must:

Remain in their original condition

Be returned in their original packaging
Products sold as part of a Final Sale promotion, meaning items discounted by 40% or more, are not eligible for returns, refunds, or exchanges. This exclusion will always be clearly communicated at the time of purchase.
Article 7 – Costs of Exercising the Right of Withdrawal
When a consumer makes use of the right of withdrawal, the costs of return shipping are the responsibility of the consumer.
Returned items must be shipped directly to Amalia Claire Boutique’s international supplier located in China.
Refunds, including the standard outbound shipping costs originally charged to the consumer, will be issued within 14 days after the returned goods have been received or once proof of return shipment has been provided.
Article 8 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Products that cannot be returned for hygiene or health protection reasons, such as earrings or lingerie

Items purchased during Final Sale promotions (discounts of 40% or more)
Article 9 – Pricing
Prices displayed in offers remain valid during the specified promotional period, unless changes are required due to legal or regulatory obligations.
Article 10 – Product Compliance and Warranty
Amalia Claire Boutique guarantees that the products and services provided comply with the terms of the agreement and meet reasonable expectations regarding quality, functionality, and reliability.
Article 11 – Delivery and Fulfillment
Orders will be processed and fulfilled with the necessary care and efficiency.
If an order cannot be delivered within the expected timeframe, the consumer will be informed as soon as possible.
Article 12 – Payment
Unless otherwise agreed, payment must be completed in full at the time the order is placed.
All transactions conducted through Amalia Claire Boutique are governed by these Terms and Conditions, which outline payment procedures, pricing policies, and delivery terms.
The entrepreneur reserves the right to correct errors relating to pricing, product descriptions, or product availability.
Article 13 – Complaints
Consumers who wish to submit a complaint may do so in writing or via email at:

Complaints will be handled carefully and responded to within a reasonable timeframe.
Article 14 – Applicable Law
Amalia Claire Boutique is operated by a company registered in the Netherlands.
All agreements between the entrepreneur and consumers are governed by Dutch law.
If mandatory consumer protection regulations in the consumer’s country of residence provide stronger protections, those statutory rights remain fully applicable.
Article 15 – Changes to the Terms
Amalia Claire Boutique reserves the right to update or modify these General Terms and Conditions.
Any significant changes will be communicated at least 30 days before they become effective.
Article 16 – Shipping and Returns
Amalia Claire Boutique collaborates with third-party fulfillment partners based in China. As a result, orders are shipped directly from China.
Approved returns must also be shipped to China. The specific return address and instructions will be provided once a return request has been approved.

Article 17 – Legal Disclaimer
The entrepreneur reserves the right to adjust the return and exchange policy at any time.
Amalia Claire Boutique maintains the final authority in determining whether a return or exchange request meets the stated conditions.
Nothing in these Terms and Conditions limits or removes rights granted under applicable consumer protection laws. Consumers retain all statutory rights, which may vary depending on their country of residence.
Spring Sale
The Spring Sale promotion at Amalia Claire Boutique is valid until the end of the spring season. After this period, promotional conditions, prices, or product availability may change or expire automatically.
